Seller privacy policy

Issue date:  21 December 2020 respects your privacy and is committed to protecting your company and personal data. This Privacy Policy will tell you how we look after your personal data when you visit our website and/or use our iOS or Android app, (together referred to as the “website” or “site”) and inform you of your privacy rights and how the law protects you.

1. Privacy Policy

We process your personal information to run our business and provide our users with the services.  By accepting our Seller Terms you confirm that you have read and understand this policy, including how and why we use your information.  If you don’t want us to collect or process your personal information in the ways described in this policy, you should not use our services.  We are not responsible for the privacy policies or practices of our sellers or other third party websites and apps.  

The Care Stockroom requires all seller account owners and delegated users to be at least 18 years of age.  By using our services you acknowledge that The Care Stockroom will use your information in the UK and Ireland and other countries where we operate.  Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside.  We will transfer personal information only to those countries to which we are permitted by law to make this transfer. 

2. Information Collected or Received

In the course of providing our services, we collect or receive your personal information in different ways.  We obtain the categories of personal information from several sources including;  directly from you, indirectly from you based on your activity and interactions with our services, or from the device or browser you use to access the service, from our vendors and suppliers that help us deliver the service to you and from third party advertising and marketing partners.  Often you choose what information to provide, but sometimes we require certain information to deliver services to you and we receive and collect this in accordance with this policy. 

You may choose at times to provide information to use via a third party API.  The Care Stockroom does not have a direct partner relationship with these third parties and their processing of information as these are subject to their own privacy policies.  Should you choose to provide information through an API you should understand the privacy and security practices of any third party before you share information with them. 

Registration, Account set up, Service usage.  In order to use these services you will need to submit a valid email address.  If you register, you will need to submit a name associated with your account.  You may modify that name through your account settings.  You need to provide such information to enable us to provide you with the services.  Additional information such as company name, brand name, billing and payment information, telephone number, credit card information may be necessary in order for us to provide a particular service.  

The name associated with your account (which you may modify in your account settings) will be displayed on your account and connected to your activity on the platform.   No personal information will be shared on the platform for buyers to see, but company name, VAT number and a link for questions relating to your products will be.   In answering these enquiries, your personal details will be made visible to buyers in the form of email or on the product pages where you have responded to questions that are shared with other buyers on that page.  If you do not wish to reveal your identity as a respondent, then you can disable this in your account settings. 

We may collect and use information about you in order to feature you in marketing materials or in the promotion of your products on and off the platform. 

Automated information.  The Care Stockroom receives and records information from your browser or your mobile device when you visit the site, use the Apps or certain features of our services such as your IP address or unique device identifier, cookies and data about where you visit and how you interact on the pages on our platform. This information is stored in log files and is collected automatically.  

If as a seller you are interacting with our platform as a buyer, you will be subject to our customer privacy policy where details of what information and how this is handled is explained. 

We also automatically collect device-specific information when you install, access, or use our services.  This information can include information such as the hardware model, operating system information, app version, app usage and debugging information, browser information, IP address and device identifiers.  

Information from Third Parties:  Some sellers may choose to link to third party applications such as Facebook.  Linking your account to a third party application service is optional.  If you choose to connect your account it is subject to the agreements with that third party (such as their terms of use and privacy notices).   We may use that information as part of providing the services to you.  You can also choose to share some of your Care Stockroom activity on certain social media networks connected to your account.  You may revoke your permission at anytime in your account settings.  

3. Messaging from The Care Stockroom

On occasion, The Care Stockroom will need to contact you.  Primarily these messages are delivered by email or via the CMS but may also be by phone.   These will include service requests, payment requests and may include other reasons such as requests for marketing, information on transactions, being an advocate for The Care Stockroom or other purposes.  This contact is necessary to provide services and for you to adhere to the rules and policies of The Care Stockroom.  You must maintain a valid email address to receive and respond to these messages and where this changes you must update new contact information via your account page. 

4. Community

The Care Stockroom is a marketplace which we hope feels like a community.  We offer features that allow sellers to communicate to buyers in public or semi-public spaces including forums, groups and on product pages. You don’t have to use these features, buy if you do, please use common sense and good judgment when posting in these spaces or when sharing your personal information with others through the service.  Be aware that any personal information that you choose to submit there can be read, collected or used by others or could be used to send unsolicited messages to you.  

We may engage certain third parties to assist in providing our services to you and in the context of that relationship, we need to share some of your information with such third parties.  This may include for example your posts on product pages, your brand name, your product information and photography.  If you close your account with us all your related personal information will be deleted.  However, your posts may remain public after your account is closed.  Please note that other sellers may follow your public activity on the site.   

5. Information uses, sharing and disclosure

We respect your privacy. The Care Stockroom will not disclose your name, email address or other information to third parties without your consent, except as specified in this policy.   Please note that any changes to your account settings may take a few days to take effect. 

When you access or use the services, we collect, use, share and otherwise process your personal information for the purposes described in this policy.  We rely on the following bases to do so;

  • Necessary to perform the contractual obligations in our Terms and in order to provide the services to you
  • You have consented to the processing which you can revoke at any time
  • Necessary to comply with a legal or regulatory obligation, a court order, or to exercise or defend any impending or asserted legal claims
  • Necessary for the purposes of our or a third party’s legitimate interests, such as those of visitors, buyers or partners
  • You have expressly made the information public
  • Occasionally necessary to protect your vital interests or those of others (in rare cases where we may need to share information to prevent injury, breach of security, or other instance where our action can prevent harm)

6. Our legitimate interests

We use your information to improve and customise our services, including sharing your information for such purposes and we do so as it is necessary to pursue our legitimate interests of improving services for our users and for you as a seller.   This includes understanding how sellers are using our platform and obtaining insights into usage patterns of those services.  As a core part of our service we have a legitimate interest in customising your experience on our platform to help you manage your account effectively. 

We use your information for safety and security purposes which can include sharing your information for such purposes and we do so because it is necessary to pursue our legitimate interests or those of a third party in ensuring the security of our services, preventing harm to individuals or property, or crime, enforcing or defending legal rights or preventing damages to The Care Stockroom systems or those of our sellers and partners.   We use your information to provide and improve services for billing and payments and for general research and aggregate reporting.  For example with cases raised, we may use information you provide to resolve disputes with a customer. 

Buying and selling.  As part of buying and selling, the Care Stockroom will facilitate the sharing of information between the two members involved in the transaction such as delivery address and payment status.  This can also involve us sharing your information with some of our third party partners such as our delivery and payment partners to enable us to provide the services to you.  Such partners will process your personal information in accordance with their own privacy policies.  In some instances, while they are subject to The Care Stockroom privacy and security requirements it is these partners and not The Care Stockroom, who are responsible for the protection of personal information under their control.   By making a sale on our platform, you are directing us to share your information in this way.  This is essential for us to provide the service to you under our obligations in our Seller Terms.   We expect you to respect the privacy of our buyers whose information you have received.  As described in our Seller terms, you have a limited license to use that information and you are not granted a license to use the information for unauthorised transactions or sending unsolicited commercial messages.  

Legal and Safety.  The Care Stockroom may also retain, preserve or release personal information to a third party in the following limited circumstances:  in response to lawful request by public authorities, including to meet legitimate security or law enforcement requirements;  to protect, establish or exercise our legal rights to defend against impending or asserted legal claims, including to collect a debt or a material violation of our policies;  to comply with a subpoena, court order, legal process, regulation, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss or investigate, prevent or take action regarding illegal activities, suspected fraud, threats to our right or property, or violations of The Care Stockroom Terms.  If we receive a lawful, verified request for a sellers records or information in one of these limited circumstances we may disclose personal information which may include, but may not be limited to, a seller’s name, address, phone number, email address, company/trading name and where appropriate, bank account and transaction details.  

Affiliated Businesses.   The Care Stockroom is affiliated with a variety of businesses and we work closely with them to perform and improve our services.  These include, but are not limited to, providing sellers with the opportunity to sign up with such partners to benefit from exclusive offers, allow them to more effectively market to you or facilitate a transaction with you or for our buyers.   We may need to share information related to the transaction with that affiliated business in order to facilitate your transaction and this forms part of the services we provide in line with our Seller and Customer Terms. 

Aggregated Information.  The Care Stockroom may share information with business partners.  This will be aggregated and de-personalised so that personal and company information is not revealed.  

Service Providers.  We also engage third party companies and individuals to help us operate, provide and market our services.  These third parties have only limited access to your information, may use your information only to address a task on our behalf, and are obliged to The Care Stockroom not to disclose or use your information for other purposes. 

Business restructuring. In some cases, The Care Stockroom may look to acquire financing or sell or buy assets.  Such transactions may be necessary and in our legitimate interest to develop our business long term.  Information about sellers may be shared for the purpose of identifying the value of our assets and the health of our business model.  This information will be subject to confidentiality between negotiating parties.   In these types of transaction, there may be a point in the transaction where assets are transferred to another party.  If The Care Stockroom intends to transfer information about you, we will notify you in writing and you will be afforded to opt out before information about you becomes subject to a different privacy policy.  

Third parties:  Third party plug-ins may also collect information about your use on our platform.  That site may register cookies directly from your browser.  These interactions are subject the privacy policy of the third-party site.  In addition, certain cookies and other similar technologies may allow other third parties to recognise your computer or mobile devise each time you use our services.  Please be aware that when you use third party sites or services, you are subject to their own terms.  We rely on your consent to drop and read these cookies when not technically necessary or not required based on another purpose other than as legitimate interest.  This policy does not apply to the practices of third parties on whom we rely to provide certain services that The Care Stockroom does not own, control or employ except as otherwise provided for in these Terms or as required by law. If you provide your information to such third parties in connection with your use of the services, different practices may apply to the use or disclosure of the information that you provide to them.  The Care Stockroom does not control the privacy or security policies of such third parties.  We encourage you to read the privacy policies and ask questions of third parties before you disclose your personal information to them.  For the purposes of European law, sellers, third party providers and API users are independent controllers of data, which means they re responsible for providing and complying with their own policies relating to any personal information they obtain in connection with the services.

Marketing and insights tools allow us to understand our users better so that we may provide users with the best possible website, products and customer service experience. We share behavioural data about our users to facilitate this process.

When you interact with our customer service team, your details are shared with our customer service platform provider.

Feedback forms

When a customer makes a purchase, we engage a third party to send out feedback forms on our behalf.

8. Security

The security of your personal information is important to us.  We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after it is received, for example encryption is used for certain information.   Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure.  Therefore, while we strive to protect your personal information, we can’t guarantee its absolute security. 

Your seller account is password protected.  It is important that you protect against unauthorised access to your account and information by choosing your password carefully and by keeping it safe, such as signing out after using the service.

9. Retention

The Care Stockroom will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as you are an active seller, or as needed to provide the services to you.  If you no longer want The Care Stockroom to use your information to provide the services to you, you may close your account.  We will retain and use your information to the extent necessary to comply with our legal obligations (for example if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements and otherwise as described in this policy.  In addition, you may as a seller be required to retain and use such information in order to comply with your own legal obligations.  

10. Rights and Choices

Certain privacy laws provide users of our platform with rights related to their personal information.  Consistent with those laws, The Care Stockroom gives you the choice of accessing, editing or removing certain information linked to your account through your account settings.  You may also remove certain optional information that you no longer wish to be publicly visible through the services, such as your name.  You can also request to permanently close your account and delete your personal information.  You have the right to correct, restrict, delete, object or withdraw consent at any time. 

11. Your Responsibilities

If you sell using our services or use one of our APIs, you may receive and determine what to do with certain personal information.  Your privacy responsibilities, including when you act as an independent data controller are laid out in The Care Stockroom seller policy.  

12. Privacy Policy Changes

We may amend or update this policy from time to time.   If we believe that the changes are material, we will let you know by email.  We encourage you to check and review these updates to stay informed of such changes.
